Privacy Policy for GN Auracast+ app

1. Introduction

This Privacy Policy explains how information is handled when you use the GN Auracast application (the “App”).

All information in the App is stored and only used on your device or other storage that you control (except for data collected by app stores, cf. Section 2).  GN Hearing A/S, Lautrupbjerg 7, 2750, Ballerup, Denmark (“we”, “us”, “our”) does not have any access to the content you store in the App and does not collect, receive, sell, or share that content.

This Privacy Policy covers:

  • Information relevant for certain data protection regimes (such as the EU General Data Protection Regulation (GDPR), the UK GDPR, and comparable privacy laws in other countries and regions, including certain US state laws).
  • What sort of data processing happens in the App.
  • What limited information may be processed outside the App (via app stores)

2. Roles Under Data Protection Laws

Because we do not have access to the data in the App, the roles under data protection laws are as follows:

You are considered responsible for your use of the App and the data processed by you in the App under any data protection laws that apply to you (for example, GDPR in the EU/EEA, UK GDPR in the UK, PIPEDA in Canada, LGPD in Brazil, POPIA in South Africa, relevant US state privacy laws, or other local laws). Specifically, under GDPR you are considered what is named a data controller.   

This is due to the fact we do not receive, access, or process the data in your App, and therefore we do not act as a data controller for that content. Neither do we act as a processor or service provider for that content.

If you download or purchase the App via an app store (for example, Apple App Store, Google Play), such a store will collect data such as your account ID, country, device type. These stores are considered independent controllers/businesses (or the closest equivalent under applicable law). Please see each app store’s own privacy policy to learn more about the app stores process your personal data.

The app store may share aggregated and limited information with us such as number of downloads in various jurisdictions and similar statistical information. We will however not receive any personal information.  

Any references to a requirement under particular national legislation in this Privacy Policy, for example, US privacy laws, do not mean that we only comply with, for example, US Privacy laws and not legislation in other regions. We only refer to, for example, US privacy laws to let you know why we provide you with certain information.   

3. Information You Use and Store in the App

3.1 Types of Information

Depending on how you use the App, you may store, for example:

Information about the devices you are connecting to, including whether your Bluetooth connection is enabled, and the type of accessory (TV-Streamer + MultiMic), UUID (Universally Unique Identifier), accessory ID, serial number. accessory firmware version, battery level, brand, and accessory settings (stereo enablement, encryption enablement, sound delay, device name, volume, broadcast code and the Auracast password entered by you)

3.2 Local Storage and Processing

The content processed in the App is stored locally on your device, except for the data shared with app stores.

If you back up your device or files (for example using iCloud, Google Drive, your own backup server or other services), those backups are under your control and governed by the privacy policies of those services, not this Privacy Policy.

4. Use of Data

In general, you can use the data located in the App to make the App connect with certain accessories.

As described above we do not (i) receive any personal data, so we do not access, collect, receive, view, or analyse the content you store in the App, (ii) use your content for analytics, advertising, or any other purpose, (iii) sell or share your content with anyone or (iv) use any sensitive personal data of yours. 

You are responsible for (i) choosing what information to store in the App and for what purposes, (ii) configuring your device securely (passwords, encryption, biometrics, etc.) and (iii) managing backups, exports, and any sharing you perform outside the App

5. Sharing of Data

As described above we do not receive any personal data and hence we do not (i) sell your personal information, (ii) share your personal information for cross‑context behavioural advertising, (iii) use or disclose your sensitive personal information in a manner that would require offering a “limit use” or (iv) share any personal information as part of international transfers.

Our practices described above (no sale, no cross‑context behavioural advertising, limited data collection) are included here to inform about our compliance with the privacy regimes of California, Colorado and other similar US state laws. You may have the rights set out in Section 6 including (where applicable) a right to appeal if we decline your request.

6. Your Rights

Your rights depend on the privacy and data protection laws in your country or region (for example, GDPR/UK, GDPR in Europe, CCPA/CPRA in California, CPA in Colorado, LGPD in Brazil, POPIA in South Africa, or similar frameworks elsewhere).

Because we do not receive your local content:

  • We cannot directly respond to access, deletion, or correction requests concerning that content.
  • If you wish to stop the collection of data about your app and accessory usage, please uninstall the app by using standard uninstall processes which are available as part of your mobile device user instructions or via the mobile app marketplace or network.

Despite the fact that we are not processing any of your personal data, you are welcome to contact us to learn more. You can do that by using the contact information info in Section 9 below. We may need to verify your identity as permitted or required by law. Where allowed, you may also be entitled to designate an authorised representative/agent to act on your behalf.

You may also have the right to lodge a complaint with your local data protection or privacy authority and in some US states you have the right to appeal a decision of ours.

7. Children’s Privacy

The App is not specifically directed to children.

Because your local content never reaches us, we cannot know whether any data about children is stored in the App.

8. Security

We have implemented reasonable and appropriate technical and organisational measures to ensure the security of the App.

However, some processing carried out by you may be out of our control and you are responsible for protecting the security of your device, passwords, and any backups you create.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time and make it available in the App. When we make material changes, we will, where required by law, provide additional notice.
